The same applies to any combination or conjunction with any other mark, symbol, logo and more generally any distinctive sign intended to form a composite logo, with the exception of logos and descriptive signs belonging to the marks present on the site. The same applies to all copyrights, designs and patents that are the property of Afyda Antara SASU.

Responsibility 
The Rack Valet is not responsible for the content and operation of the sites linked to this site, as well as for any damage of any kind that may be suffered by the visitor on the occasion of a visit to these sites.

General Terms and Conditions of Sale

Article 1: Purpose
The purpose of The Rack Valet is to manage an online sales platform dedicated to the sale and promotion of the The Rack Valet brand and possible partner brands.

Article 2: Acceptance of General Conditions
Acceptance of the general terms and conditions of sale is tacitly effected by the validation of the order by the customer. By making the payment, the user indicates that he accepts these terms and conditions without reservation.

Article 3: Completion of Sales
The sales are perfect between the parties and the property is acquired to the buyer as soon as the payment of the item, little important the date of delivery.

Article 4: Disclosure obligations
The Rack Valet meets its duty to provide advice and pre-contractual information, as set out in Article L121-18 of the Consumer Code and the sections to which it refers.
The essential characteristics of the articles are reproduced in the detailed description accompanying the photographs of the articles.
Compliance with Article L121-19 of the French Consumer Code results from the confirmation of the order.

Article 5: Customer account
The site is freely accessible without registration, but any order requires the registration of the purchaser.
The following are required: civility, first name, last name, email address, password, telephone number and delivery address.

Article 6: Prices and means of payment
The prices are indicated all taxes included in France and the European Union. Outside the European Union additional customs fees/ carrier may need to be paid at the reception. The items are provided at the price in effect at the time of placing the order. Payment is by credit card, paypal or bank transfer.

Any discount codes applied do not apply to delivery charges, with the exception of specific free delivery coupons. They cannot be reimbursed.

Payment data are not retained by The Rack Valet or the financial transaction organization.The receipt of the price is immediate.

The information you give us when you order and pay by credit card is automatically processed by our payment partners. The purpose of this automated data processing is to define a level of analysis of transactions and to fight against credit card fraud, theft and misuse of your identity.

The Rack Valet and its payment partner organisations are the only recipients of data related to your order. Your card number is never transmitted or used as is, but has a secure encryption and encryption system. The highest security standards are applied to data storage and all comply with the Payment Card Industry Data Security Standard (PCI DSS). Article 7: Price adjustments in balances
If an item has been purchased within 7 days prior to the start of the sale or a promotion period, The Rack Valet may credit the price difference on request in the form of a credit on the customer account. This credit will be granted provided that the product including the size is always available for sale on the site at the time of the request by the customer. This credit will be valid for 12 months after approval of the credit.

Any item purchased that is discounted or discounted will not benefit from this downward adjustment.

Article 8: Rates and delivery time

Delivery costs are free for metropolitan France.
For the other destinations, they will be the subject of an estimate at the time of placing the order.

Article 9: Unavailability of ordered goods
If exceptionally, the item ordered was no longer available, the buyer may either make an exchange, or be reimbursed without delay and at the latest within thirty days of payment of the sums he paid.

Article 10: Quality of Articles
The quantity and qualities of the delivered item are those fixed at the time of ordering.
The Rack Valet reserves the right to modify the goods to be delivered under the assumption described in paragraph 2 of article R132-2 of the French Consumer Code, that is, when the changes are related to technical developments and do not result in any price increase or alteration of the quality of the product, on the understanding that the consumer is free to mention the characteristics to which he makes his commitment subject.
The items sold by The Rack Valet are guaranteed new in accordance with the law in force and have, under no circumstances, been the subject of prior use.

Article 11: Non-compliance of the order/ damaged article
Article L121-20-3 of the French Consumer Code states that The Rack Valet, as a professional, is automatically responsible to the consumer for the proper performance of the obligations resulting from the distance contract, that these obligations are to be performed by the professional who has concluded this contract or by other service providers, without prejudice to his right of recourse against them-on the other hand that it may be exonerated from all or part of its liability by proving that the non-performance or improper performance of the contract is attributable either to the consumer or to the fact, unforeseeable and insurmountable, of a third party to the contract, or to a case of force majeure. In the event of an anomaly concerning the delivery, that is to say in the case of defective or non-compliant articles in kind (color reference error), the Customer must as soon as possible or on the same day of delivery, send his complaints to The Rack Valet by email, on the following address: customer@therackvalet.com.

Any claim made after 3 days after delivery cannot be accepted.
The absence of complaints, the non-issuance of reservations on the part of the Customer means that the delivered article is deemed satisfactory and cannot be the subject of any subsequent dispute.

Article 12: Cancellation: Right of withdrawal

Pursuant to Article L 121-20 of the French Consumer Code as amended by Order No. 2001-741 of 23 August 2001 and Law No. 2014-344 of 17 March 2014, the withdrawal period is 14 days from the day after receipt of the article.
The exercise of this right is done by email to our customer service, or via a registered letter with acknowledgement of receipt formalizing the deadline of 14 calendar days with The Rack Valet.
The exercise of this right entails the reimbursement of the sums paid, after qualitative and quantitative verification of the returned items.

Article 13: Returns
In France, The Rack Valet will cover the return costs by sending a prepaid return voucher.Outside France, the means of return will be at the initiative, convenience and expense of the customer.
The products must be in good condition and returned to their original packaging, to which a package covering the entire product is added;they must bear no trace of use, be accompanied by their accessories.
Only after verifying that these conditions are met will The Rack Valet refund the amounts collected for the returned items, with the exception of the initial shipping charges.Otherwise, no refund can be payable, the customer will remain the owner of the product, which he can come to pick up at the headquarters of therackvalet.com within a maximum of one month.
In case of partial return of an order whose total initial amount justified a free delivery, shipping costs corresponding to the items kept by the customer will be deducted from the amount refunded by The Rack Valet, as a participation in the shipment of the products.

Article 14: Data protection law and freedoms
In accordance with Law 78-17 of 6 January 1978 revised by Law 2004-801 of 6 August 2004, you have the right to access and correct your personal data. Through us, and only if you have given your initial consent at the time of registration, your address may be forwarded to third party partners of The Rack Valet. Article 16: Litigation
Any disputes that may arise over the performance and interpretation of these general conditions shall be brought before the courts which shall have sole jurisdiction.

These terms and conditions take effect from 1 November 2015.
The Rack Valet reserves the right to modify certain elements of these terms and conditions during the year.
